1. Acceptance of Terms

By accessing or using EraMe ("the Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.

These Terms apply to all visitors, users, and others who access the Service ("Users").

2. Description of Service

EraMe provides personalized reports based on birth year and generational psychology. The Service includes:

• Free Birth Era Reports
• Premium Extended Reports
• Couples and Family Reports
• Subscription services
• Related content and features

3. Important Disclaimers

3.1 AI-Generated Content

All reports are generated using artificial intelligence language models. You should understand that:

• Automated Content: Reports are created through automated AI processing based on your inputs
• Generalized Insights: AI generates content based on patterns and generalizations, not individual analysis
• Potential Inaccuracies: AI systems may occasionally produce inaccurate, incomplete, or inappropriate content
• No Human Review Guarantee: While we refine AI outputs, not all content receives individual human review
• Educational Content: Reports are meant for personal insight and learning, not decision-making

3.2 Not Scientific or Diagnostic

No Astrology: EraMe is not an astrology service. We don't use zodiac signs, planetary positions, or horoscopes. Our insights are based on generational psychology and cultural analysis.

Probabilistic Patterns: Our reports describe common patterns and tendencies for people born in certain eras. They don't predict individual outcomes, define who you are, or determine your future.

No Medical or Psychological Claims: We make no claims about diagnosing, treating, or preventing any medical or psychological condition. Reports are not validated psychological assessments.

4. User Accounts and Data

4.1 Accuracy of Information

You agree to provide accurate information when using our Service. Providing false information may result in inaccurate reports and potential suspension of access.

4.2 Age Requirements

You must be at least 13 years old to use EraMe. Users under 18 should have parental consent. For Parenting Reports about children, the parent must provide consent.

4.3 Account Security

You're responsible for maintaining the security of your email and any account access. Report tokens are personal and should not be shared widely.

4.4 Data Retention and Deletion

You can request deletion of your personal data at any time. To request deletion:

• Email privacy@erame.co with "Data Deletion Request" in the subject
• Include your email address and any order numbers
• We'll process your request within 30 days

What happens when you request deletion:

• Your personal information (name, email, birth date) will be permanently deleted
• Your report content will be deleted or anonymized
• Access to any purchased reports will be revoked
• Marketing emails will be stopped immediately

Information we must retain:

• Payment records (required for tax/legal compliance, typically 7 years)
• Records necessary to resolve disputes or enforce our Terms
• Aggregated, anonymized analytics data (contains no personal identifiers)

4.5 Data Portability

You can receive a copy of your personal data in a portable format. To request your data:

• Email privacy@erame.co with "Data Export Request"
• We'll provide a JSON or CSV file with your data within 30 days
• Export includes: name, email, birth date, purchase history, report content

5. Payments

5.1 Digital Goods

All EraMe reports and subscriptions are digital goods delivered electronically. By purchasing, you acknowledge that:

• Reports are delivered instantly via email and download link
• You receive immediate access to digital content upon purchase
• Digital goods cannot be "returned" once accessed or downloaded
• You are purchasing a license to use the content, not the content itself

5.2 Pricing

Prices are listed in US Dollars and may change without notice. Current prices are displayed at checkout. All sales are final except where required by law.

5.3 Payment Processing

Payments are processed by Stripe, a third-party payment processor. By making a purchase, you also agree to Stripe's terms of service. We do not store your credit card information.

5.4 Subscriptions

Monthly and annual subscriptions renew automatically until cancelled. You can cancel anytime through your account settings or by emailing support@erame.co. Cancellation takes effect at the end of the current billing period. No refunds or prorated credits are provided for early cancellation.

Subscription Details

• Auto-Renewal: Subscriptions automatically renew on the monthly or annual anniversary of your purchase
• Renewal Notices: We'll send reminder emails 7 days before renewal
• Price Changes: If prices change, we'll notify you at least 30 days before your next renewal
• Cancellation Window: Cancel at least 24 hours before renewal to avoid being charged
• Access After Cancellation: You retain access until the end of your paid period
• Reactivation: You can reactivate a cancelled subscription at any time

5.5 Refund Policy

All sales are final. We do not offer refunds for digital report purchases or subscriptions, except where required by law.

If you experience a delivery issue or believe you were charged in error, contact support@erame.co and we will help resolve it promptly.

6. Intellectual Property

6.1 Our Content

The Service and its content, features, and functionality are owned by EraMe and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Report

You receive a personal, non-transferable license to use your report for personal purposes. You may:

• Print and share your own report
• Discuss your report's contents
• Quote brief excerpts with attribution

You may not:

• Resell or redistribute reports
• Use reports for commercial purposes without permission
• Claim authorship of report content
• Remove or alter copyright notices

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Submit false information or impersonate others
• Use automated systems to access the Service without permission
• Attempt to reverse engineer or extract our algorithms
• Submit content designed to manipulate AI systems (prompt injection)
• Use the Service to harass, abuse, or harm others
• Violate any applicable laws or regulations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Service is provided "AS IS" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

EraMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless EraMe and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

10. Third-Party Services

The Service may contain links to or integrate with third-party services. We're not responsible for the content, privacy policies, or practices of third-party services. These include:

• Payment processing (Stripe)
• Email delivery (Postmark/Sendgrid)
• Analytics (Google Analytics)
• AI providers (OpenAI/Anthropic)

11. Termination

We may terminate or suspend your access to the Service immediately, without notice, for:

• Breach of these Terms
• Fraudulent or abusive behavior
• Non-payment of fees
• Any other reason at our discretion

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions.

12.2 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the issue informally for at least 30 days.

12.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall be conducted in English in Delaware.

12.4 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions.

13. Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes by:

• Posting new Terms on this page
• Updating the "Last Updated" date
• Sending email notification for material changes

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EraMe regarding the Service.

16. Customer Support

Self-Service Platform: EraMe is designed as a self-service platform. Most questions can be answered through:

• Email confirmation and report delivery instructions

Support Availability: While we strive to assist users when needed, we do not guarantee:

• Specific response times to support inquiries
• 24/7 customer support availability
• Phone or live chat support
• Personalized report customization or editing
